Guest Play Rules

Rules Effective: 27 June 2023

1. INTRODUCTION

1.1 These Guest Play Rules (“Rules”) contain the terms and conditions applicable to a Guest’s access to and activity at the Casino. Capitalised terms used in these Rules are defined in Rule 10. 
1.2 These Rules are effective from the date displayed above.
1.3 An application to become a Guest and at the time of each subsequent entry to the Casino by the Guest constitutes an acceptance of these Rules as amended from time to time and an agreement by the Guest to comply with these Rules. 
1.4 Crown may amend these Rules from time to time in accordance with Rule 3.
1.5 Crown reserves the right to refuse a Guest’s application or access to the Casino at any time and for any reason. 

2. ANTI-MONEY LAUNDERING AND COUNTER-TERRORISM FINANCING OBLIGATIONS

2.1 Crown and each entity within the Crown Group is subject to the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (the “AML/CTF Act”) and the Anti-Money Laundering and Counter-Terrorism Financing Rules Instrument 2007 (No. 1) (the “AML/CTF Rules”).
2.2 Crown collects Guest’s personal information for the purposes of Crown’s customer identification processes and related purposes to comply with its obligations under the AML/CTF Act and AML/CTF Rules.
2.3 In accordance with its obligations under the AML/CTF Act and the AML/CTF Rules, Crown will, from time to time:
a) require Guest’s to produce Acceptable Identification; 
b) collect, record and verify information regarding Guests and their transactions;
c) collect further Know Your Customer (KYC) information; and
d) conduct Enhanced Customer Due Diligence (ECDD) on Guests which may be performed by third parties; and
e) conduct identity document (ID) verification on Guests, which may be performed by third parties.

3. CHANGES TO TERMS AND CONDITIONS

3.1 Crown reserves the right to amend or alter the Rules at any time.
3.2 Crown will make the updated Rules available on crownsydney.com.au
3.3 It is the Guest’s responsibility to ensure that they keep up to date with the Rules. 

 4. GUEST ACCOUNTS AND GUEST CARDS

4.1 Crown will create an Account for each Guest.
4.2 Guests will be issued with a temporary Guest Card. The temporary Guest Card will be linked to the Guest’s Account. 
4.3 A Guest is only entitled to one (1) valid Guest Card.
4.4 The Guest Card must be presented on entry by the Guest to the Casino or otherwise on request by Crown. A Guest Card remains the property of Crown and must be returned to Crown on request by Crown.
4.5 If following the Guest’s initial visit to the Casino, the Guest is eligible to be granted access to the Casino and Crown determines that the Guest will be granted access to the Casino, the Guest may be required to provide Acceptable Identification in order to be issued with a temporary Guest Card for the duration of that visit. The process for issue of a new temporary Guest Card must be followed by the Guest for each subsequent visit to the Casino.
4.6 It is the responsibility of the Guest to safeguard their Guest Card and take precautions against the loss, or any unauthorised use, of their Guest Card.
4.7 A Guest Card issued to a Guest may only be used by that Guest.
4.8 A Guest must not give their Guest Card to another person for any purpose whatsoever. A breach of this Rule shall be considered Guest Card misuse, which may result in Crown taking action against the Guest including excluding the Guest.
4.9 If a Guest’s Guest Card is lost or stolen, the Guest must immediately report the loss or theft to Crown (and, in some circumstances, such as where there is alleged fraudulent use of the Guest Card, may be required to produce a police report if requested by Crown). In such circumstances, Crown will not be responsible for any use of the Guest Card, including any use of funds or credits by a person other than the Guest.
4.10 Crown may replace a lost, stolen or damaged Guest Card at its discretion, subject to Crown’s Acceptable Identification requirements. Crown reserves the right to charge a reasonable fee for replacement Guest Cards or to cancel a Guest’s Guest Card or Account if a Guest, in Crown’s opinion, has claimed an excessive number of lost, damaged and/or stolen Guest Cards.

5. GUEST PIN

5.1 In order to use the Card Play and Card Play Extra functionality referred to in Rule 6 below, a Guest must select a PIN for their Guest Card. The PIN will be linked to the Account for that Guest.
5.2 A PIN issued to a Guest may only be used by that Guest. A Guest must not disclose their PIN to another person for any purpose whatsoever. A Guest must take all necessary precautions to safeguard their PIN and must not maintain a written record of their PIN. 
5.3 Acceptable Identification must be provided by the Guest when selecting or resetting a PIN. Crown reserves the right to require the Guest to choose an alternative PIN if a PIN has been:
a) forgotten;
b) abandoned; or
c) ‘locked’ in those circumstances referred to in Rule 5.4 below. 
5.4 If a PIN is incorrectly entered on three (3) consecutive attempts, Crown reserves the right to restrict or prevent further use of that Guest Card until the PIN is reset at a Crown Rewards or reception desk or via the available systems, in accordance with Rule 5.3.
5.5 To the extent permitted by law, Crown will not be liable for any unauthorised use if a Guest Card is lost or stolen or a PIN becomes known to another person. 

6. CARD PLAY AND CARD PLAY EXTRA

6.1 Card Play and Card Play Extra are available at the Casino to Guests through the use of a PIN selected by the Guest in accordance with Rule 5, subject to Acceptable Identification having been provided and remaining valid and current as determined by Crown. 
6.2 Card Play / Card Play Extra must be used to play an automated table game. In order to use Card Play / Card Play Extra to play an automated table game, funds must be transferred into the Guest’s Account by the Guest at the cage of the Casino. These funds will then be available as credits for play by using the Guest Card at an automated table game. The withdrawal of all or part of the balance of funds in a Guest’s Account must be done by the Guest at the cage of the Casino.
6.3 During any period of technical malfunction resulting in Card Play or Card Play Extra being unavailable, a Guest will be unable to access any applicable funds until the technical issue has been resolved.
6.4 Crown will not be responsible or liable for:
a) incomplete or erroneous machine credit transfers as instigated by the Guest;
b) any credits left or abandoned on an automated table game as a result of an incomplete or erroneous machine credit transfer instigated by a Guest or as a result of a Guest failing to instigate a machine credit transfer;
c) the unauthorised removal or play of credits or funds from a Guest’s Card by a person or persons other than that Guest (except by Crown); or
d) any loss or damage of any kind relating to any technical malfunction as described in Rule 6.3.
6.5 Crown may, at its discretion, adjust a Guest’s Card credit or fund balance if such credits or funds are, in Crown’s opinion, obtained in error or by fraudulent means or if such credits or funds are removed and/or credited by Crown as a result of a technical malfunction or by reason of operator fault, misrepresentation for which Crown is not responsible or any other reason outside Crown’s reasonable control.
6.6 Crown may, at its discretion, at any time cease Card Play or Card Play Extra functionality on any automated table game on any Guest’s Card. In this event, any funds remaining on a Guest’s Card will be paid directly to that Guest upon the Guest presenting at the cage of the Casino to claim such funds with Acceptable Identification.
6.7 Funds loaded to a Guest’s Card via Card Play and Card Play Extra at the Casino are not accessible by that Guest at any other Crown Group property and cannot be transferred between each property.
6.8 Funds loaded to a Guest’s Card via Card Play and Card Play Extra cannot be transferred to a different Guest, Member or other person.
6.9 If Crown considers a Guest’s Account to be dormant, including in the event that a Guest’s Account does not register a transaction during any continuous period of 180 days, Crown may transfer or return any Card Play / Card Play Extra balances remaining in the Guest’s Account to the Guest in a manner of Crown’s choosing.
6.10 If a Guest’s access to the Casino is suspended or terminated for any reason (including if the Guest is excluded, the Guest’s licence is withdrawn or the Guest is no longer eligible to access the Casino as a Guest), Crown may transfer any Card Play / Card Play Extra balances remaining in the Guest’s Account to the Guest in a manner of Crown’s choosing.  The Guest must provide such further information as may be required by Crown for the purpose of facilitating the return of such funds. 
6.11 Crown will not be responsible or liable if Crown makes a transfer or seeks to return funds to a Guest in accordance with Rule 6 and the transfer or funds are not received by the Guest. 6.12 In the event that Crown is unable to transfer or return the funds to the Guest, Crown will deal with those funds in accordance with its policies relating to unclaimed monies.   
6.13 Crown may place a limit on the maximum credit or fund balances that can be held on or transferred to a Guest’s Card. Crown may reject any transaction that could result in a Guest’s Card exceeding the maximum limit or transfer any Card Play / Card Play Extra balances exceeding the maximum limit to the Guest in a manner of Crown’s choosing 
6.14 A Guest must not conduct, or request Crown to conduct, any transaction using Card Play / Card Play Extra which is not directly related to gambling at the Casino. A Guest must not use Card Play / Card Play Extra for any other purpose than to fund that Guest’s own gambling activities at a Crown casino. A Guest must not use Card Play / Card Play Extra in breach of any law.

7. PLAYER ACTIVITY STATEMENTS

7.1 A player activity statement in respect of a Guest’s play on automated table games while using their Guest Card at the Casino may be available on request – speak to a Crown Casino staff member for further information.

8. LIABILITY

8.1 Nothing in these Rules is intended to affect any rights that a Guest may have including under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) and the Fair Trading Act 1987 (NSW) which cannot be excluded. By way of example, as a consumer, a Guest has the benefit of certain consumer guarantees which cannot be excluded by a provider of goods or services.
8.2 Subject to Rule 8.1 and to the extent permitted by law, Crown, the Crown Group and the Related Bodies Corporate of Crown and the Crown Group (including their officers, employees, agents and contractors) are not and will not be liable for any damages or any other loss incurred by a Guest (including consequential loss), either directly or indirectly in connection with these Rules (including, without limitation, changes to the Rules), except to the extent caused by the negligence, wilful misconduct or wrongful act or omission of Crown, the Crown Group and their Related Bodies Corporate or their officers, agents or employees.

9. GENERAL

9.1 Crown’s decisions in respect of these Rules are final and binding.
9.2 Any tax liabilities and other duties arising from the accumulation and redemption of credits and the receipt and use of any other benefit are and remain the sole responsibility of the Guest. Furthermore, Crown recommends Guests seek independent tax advice about any tax consequences of the accumulation and redemption of credits and any other benefit.
9.3 Any alteration made to Associated Documentation by any person other than Crown may have the effect of automatically invalidating that Associated Documentation. Associated Documentation cannot be replaced or re-credited if such Associated Documentation is lost, stolen, damaged or destroyed and should be kept in a safe place and in good condition by the Guest.
9.4 In consideration of Crown approving an application to admit the Guest, creating an Account for the Guest, admitting the Guest to the Casino and by use of a Guest Card, the Guest accepts and agrees to be bound by these Rules as amended from time to time and acknowledges the right of Crown to rely upon them as an indication of the Guest’s consent to any acts authorised or contemplated by these Rules.
9.5 For the avoidance of doubt, Crown reserves its right to waive in respect of any Guest any right or requirement of these Rules and/or the application of, or compliance with any of these Rules. Any such waiver does not operate as a waiver of such right, requirement, application or compliance if it arises again.
9.6 These Rules are governed by the laws of the State of New South Wales. Each party submits to the jurisdiction of the courts of that State and of any court that may hear appeals from any of those courts, for any proceedings in connection with these Rules.
9.7 To the extent that any provision in these Rules is illegal or unenforceable, it is severed without affecting the validity or enforceability of the remaining Rules.

10. Definitions

Acceptable Identification” means such current and valid forms of identification from the Guest as Crown requires in its sole discretion from time to time. Such Acceptable Identification must be valid and current and, as a minimum, comply with customer identification procedures in the AML / CTF Act. Crown may in its sole discretion choose not to accept identification that is provided in digital form only and may require a physical form of identification to be provided. 

Account” means the digital record maintained by Crown of a Guest’s details including the Guest’s available funds, credits, activity and personal details. 

AML/CTF Act” has the meaning given to that term in Rule 2.

AML/CTF Rules” has the meaning given to that term in Rule 2.

Act” means the Casino Control Act 1992 (NSW).

Associated Documentation” means the various documentation that a Guest may use as part of their participation in activities at the Casino, such as a table player voucher, a TITO (ticket in, ticket out) voucher or a competition or promotion entry form.

Card Play” means the machine credit transfer function referred to in Rule 6, which allows for the transfer of automated table game credits from a valid automated table game as applicable to a Guest Card (and vice-versa).

Card Play Extra” means the deposit and withdrawal functionality referred to in Rule 6, which allows for funds to be deposited or withdrawn directly to or from a Guest Card.

Crown” means Crown Sydney Gaming Pty Ltd ACN 166 326 843.

Crown Group” means Crown Resorts Limited ACN 125 709 953, any of its subsidiaries, and any other entity which the directors of Crown Resorts Limited are required to consolidate in the consolidated profit and loss accounts and balance sheets of Crown Resorts Limited under the Corporations Act 2001 (Cth).

Guest” means an approved person who is permitted access to the Casino as a guest in accordance with the Casino Guest Policy. 

Guest Card” means a physical card validly issued by Crown to a Guest which is connected to the Guest’s Account

Member” means a person who has been granted Casino Membership under the Casino Membership Policy and who continues to remain a Casino Member in accordance with the Casino Membership Review Policy.

PIN” means a personal identification number or word in a format specified by Crown. 

Related Bodies Corporate” has the meaning given to that term in the Corporations Act 2001 (Cth). 

Casino” means the boundaries of the Barangaroo Restricted Gaming Facility as defined under section 19A of the Act (other than back of house areas).

Casino Guest Policy” means the policy relating to access to the Casino by Guests, contained in the Casino Membership Policy, as amended from time to time. 

Casino Membership Policy” means the policy relating to access to the Casino, as amended from time to time.
